EMPLOYER INFORMATION

If you require help or further understanding of the laws and obligations of employing a nanny or caregiver, we can assist you. Please contact us with any questions.

By law, you are required to pay your nanny/caregiver minimum wage or more. When you apply to the Human Resources and Skills Development Canada (HRSDC) for approval of your employment offer and you offer less than the minimum required by law, your application will likely be refused. If your application is approved, then you are bound by the terms and conditions of the HRSDC approval.  You may wish to click on the link below for more information. www.hrsdc.gc.ca/en/lp/spila/clli/eslc/01Employment_Standards_Legislation_in_Canada.shtml

Live-in nannies/caregivers in Canada are covered by Employment Insurance (EI).  You must remit the deducted amount together with your contribution to the Canada Customs and Revenue Agency.  You may wish to click on the link below for more information. www1.servicecanada.gc.ca/en/ei/menu/eihome.shtml

You must deduct provincial and federal income tax from every pay cheque you give to your nanny/caregiver. At the end of year, you must send a record of the wages and deductions to Revenue Canada Taxation. You must provide a T4 form to your employee (nanny/caregiver). The T4 form will allow the nanny/caregiver to file her income tax report by the end of April of each year.  You may wish to click on the link below for more information. www.cra-arc.gc.ca/tx/ndvdls/fq/menu-eng.html

CPP is another plan to which both you and your caregiver must make contributions.  You may wish to click on the link below for more information. www.hrsdc.gc.ca/en/isp/cpp/cpptoc.shtml

In some provinces, workers' compensation benefits, registrations and payments are mandatory. Find out what rules apply in your province.  You may wish to click on the link below for more information. www.hrsdc.gc.ca/en/labour/workers_compensation/index.shtml
